Estranged Husband of Denise Richards Sued for $148K in Cancer Treatment Fraud Case
A man is seeking a six-figure court ruling against Aaron Phypers, the estranged spouse of Denise Richards, alleging he broke commitments made to the man's terminally ill wife, according to an exclusive report by Us Weekly.
On Wednesday, November 19, Rupert Perry filed a request with a Los Angeles Superior Court judge, asking for a default judgment of $148,652 against Phypers, 53. Perry oversees the estate of his deceased wife, Elina Katsioula-Beall. This sum includes $126,000 that Perry asserts Phypers owed Katsioula-Beall, plus an additional $21,000 for interest and various charges.
Perry states he properly notified Phypers of the legal action concerning alleged fraud and a contract violation, but Phypers has not yet formally replied to the proceedings.
Perry's initial legal filing detailed that his wife received a diagnosis of sarcoma cancer in 2019. He further explained that conventional medical approaches were ineffective, prompting her to investigate alternative therapies. According to Perry, they had a meeting with Phypers in June 2023 at his wellness facility, which is no longer operational.

Perry alleged that Phypers informed him he possessed a therapy for her cancer that would “either cure or significantly improve” her health. The lawsuit stated Phypers claimed the treatment boasted a 98% success rate and even guaranteed a 50% reimbursement if it proved ineffective. Katsioula-Beall then paid Phypers $126,000 for this therapy.
According to the filing, Katsioula-Beall underwent treatments from July to September 2023, yet they yielded no positive results. By December 2023, Katsioula-Beall’s tumor had expanded by 25 percent over the previous quarter. Perry recounted that his wife contacted Phypers, asking for the 50 percent refund, which amounted to $63,000. Phypers then proposed she engage in a further course of treatment.
Perry mentioned that his wife attempted to contact Phypers once more in February, but received no reply. “On March 29, 2024, while succumbing to cancer, [Katsioula-Beall] dispatched an additional email to [Phypers], including an invoice for $63,000 and urging prompt payment. [Phypers] once more disregarded her plea and provided no answer,” Perry stated.
Katsioula-Beall passed away on May 21, 2024. Perry communicated with Phypers on June 28, 2024; Phypers reportedly admitted to the outstanding amount but offered justifications for his failure to pay.
During that period, an individual close to Phypers informed In Touch that Phypers viewed himself as an intermediary and felt the service-providing company should be accountable for the reimbursement. This source asserted that Phypers had made efforts to get in touch with the company’s CEO, but without success. The court's decision is still pending.
Perry's pursuit of this substantial financial ruling coincides with Phypers' pleas for assistance amidst his current divorce proceedings from Richards, 54. This petition follows his arrest on October 17, several weeks prior, on accusations connected to alleged abuse against the RHOBH personality.

In his latest legal submission, Phypers stated, “My economic circumstances deteriorate daily. My pickup truck, now my sole mode of transport, faces potential repossession. I live under the constant threat of eviction. I am relying on friends for funds just to afford sustenance.”
“I am currently facing criminal charges and must secure legal counsel for my defense prior to my upcoming court appearance, scheduled for mid-December,” Phypers declared. “I am at imminent risk of becoming unhoused, without transportation or a mobile phone, unless my hearing date can be brought forward and court orders issued granting me access to the considerable assets currently managed by [Richards],” he added.
Phypers detailed that “to maintain his livelihood,” he requires $125,000 for overdue rent, $2,673 for delinquent vehicle registration, $17,820 for outstanding pickup truck payments, $10,000 for unpaid HOA dues, $1,960 for storage costs, $3,500 for a past-due water bill for reconnection, $12,000 for overdue electricity (“at risk of disconnection”), $150,000 for legal expenses, and sundry other outstanding payments.

Phypers listed his regular monthly costs for “fundamental living and sustenance” as $15,000 for rent, $12,000 for groceries and additional outlays, $2,000 for his vehicle, $380 for vehicle insurance, $193 for internet service, and $300 for mobile phone service.
As initially disclosed by Us, Richards and Phypers faced an eviction lawsuit from their landlord on November 7. The legal action alleged that the pair owed more than $80,000 in unpaid rental fees. Richards vacated the property under dispute in 2023. Phypers and his relatives have remained residents of the dwelling.
This legal complaint was filed on the identical day Richards secured a permanent protective order against Phypers. The actress gave testimony asserting that he had subjected her to abuse on numerous occasions throughout their marriage. Phypers firmly refuted these accusations.
