Jay Cutler Faces Lawsuit from DUI Victim Just Days Before Jail Sentence
Just days after learning he would serve a four-day jail sentence for his 2024 DUI arrest, Jay Cutler has been served with a lawsuit, Us Weekly reveals exclusively.
The former NFL quarterback is now facing legal action initiated on Tuesday, September 2, by Perry Lee, the driver whose vehicle Cutler struck while allegedly under the influence.
According to court documents obtained by Us, Lee asserts that Cutler, 42, was entirely “at fault for the collision,” citing that the former athlete drove too closely, neglected to keep a proper lookout, and failed to concentrate on the road.
The complaint from Lee states, “Cutler did not exercise reasonable and due care in operating his vehicle, thereby failing to prevent injury to other road users, including [Lee].” His legal team further emphasizes Cutler's alleged intoxication at the time of the incident.
Lee claims to have suffered significant medical and other related expenses due to the accident. Furthermore, he reports experiencing physical and emotional distress, along with a diminished quality of life. The lawsuit seeks unspecified monetary compensation.
Representing Lee, Morgan & Morgan founder John Morgan and attorney Sydney Pierce informed Us, “Our client, a veteran, sustained injuries in a car accident attributed to the alleged carelessness of the other driver.”

They further stated, “The injuries he sustained from the collision inflict constant pain and have significantly impacted his well-being. We are pursuing justice on his behalf to ensure he receives necessary treatment and can begin to rebuild his life.”
Previously, on August 26, Us reported that a Tennessee judge mandated Cutler to serve a period in the Williamson County jail, complete DUI education courses, and pay fines totaling $350.
Following his release, the former football player will face a temporary driver’s license suspension and will be subject to one year of unsupervised probation.
The arrest occurred on October 17, 2024, following an alleged rear-end collision. The occupant of the other vehicle informed authorities that the ex-NFL star supposedly offered $2,000 to dissuade him from contacting law enforcement.
Officers’ reports indicated that Cutler appeared to be "staggering, swaying, and heavy-footed" upon their arrival at the scene, observing his eyes as "bloodshot" and "watery." Initially, he denied consuming any alcohol before operating his vehicle, the report states.
However, when questioned again about earlier alcohol consumption, Cutler admitted to an officer, “a little bit.”

Cutler declined to undertake a field sobriety test, prompting officers to transport him to a hospital for a blood sample collection. A subsequent search of his vehicle revealed a "loaded Glock handgun." He was then booked on charges including DUI, unlawful possession of a weapon while intoxicated, and failing to operate a vehicle with due care to prevent an accident. He was later released on bond.
Through a plea agreement with prosecutors, Cutler admitted guilt to a single misdemeanor DUI charge, leading to the dismissal of the remaining accusations.
His jail sentence is scheduled to commence on September 29.
