Kim Zolciak Ordered to Testify in Extravagant Divorce Case Involving Alleged Gifts
Kim Zolciak was ordered to testify in court as part of an ongoing divorce battle between a man and his estranged spouse, who demanded the former Real Housewives of Atlanta personality provide answers regarding gifts he allegedly bestowed upon her, Us Weekly can exclusively confirm.
On September 30, legal documents were submitted indicating that Zolciak received a summons requiring her to appear for a sworn deposition within the divorce proceedings of a man identified as Kyle Mowitz.
Mowitz initiated divorce proceedings against his wife, Jillian Green, in March. The paperwork stated Zolciak was served in the parking area of a high school situated in Georgia.
A legal representative for Zolciak, 47, responded to the request for her to attend a deposition on October 15 and to present specific documents and correspondence.
Zolciak opposed the demand for her mandatory appearance. She characterized the subpoena as “unreasonable, oppressive, and designed to harass and mortify her.”
The legal order requested Zolciak to hand over all communications exchanged with Mowitz, any discussions between Zolciak and another third party concerning “payment for services or communications regarding [Mowitz],” Green, their children, or the divorce. It also sought any records related to presents received from Mowitz, or from any business he owns.
Green additionally sought “any and all records concerning or pertaining to your financial association with Kyle Mowitz, including but not limited to gifts given or received from Kyle, expenses paid on your behalf by Mr. Mowitz or any business he is affiliated with, funds loaned to you, and monies disbursed to you by Mr. Mowitz or any businesses with which he is connected.”
The subpoena further mandated Zolciak to provide documentation regarding travel undertaken with Mowitz, encompassing the travel arrangements, itinerary, lodging details, and the settlement of all costs linked to said travel.

Green also wished for Zolciak to submit communications with other individuals, and any and all documentation relating to any contact between Zolciak’s estranged husband, Kroy Biermann, and Mowitz.
Mowitz’s attorney, Marvin Solomiany, informed Us, “We are not going to debate the particulars surrounding our client’s divorce case outside of the applicable legal procedures. We encourage you to review the filings we have submitted on our client’s behalf, which accurately convey our client’s stance concerning this matter. Regarding Ms. Kim Zolciak, Ms. Mowitz’s decision to involve her in the divorce case is wholly gratuitous as any relationship our client may have with her commenced only after the parties’ separation.”
A judicial decision has not yet been rendered.

In his initial petition, Mowitz cited the marriage date as June 24, 2017, and declared they were currently living apart. Mowitz stated he shares two underage children with his estranged wife.
The documentation showed the former couple resided in separate residences in Georgia. He petitioned the court to grant him shared legal and physical custody of their offspring.
Mowitz also asserted there was no prospect for reconciliation with his former partner. He contended his wife did not require financial assistance and argued she was an “able-bodied adult capable of securing remunerative employment.”
A month later, Green responded to Mowitz’s petition. She requested the court to grant her primary custody but agreed to joint legal custody. Her counterclaim sought for Mowitz to provide her with child and spousal support.
In her submission, Green maintained she had confidence in her ex to manage their “considerable assets.”

She alleged Mowitz established a family trust in 2021. “[Mowitz] was engaged in an extramarital affair and contemplating divorce at the time he created and funded the Trust” the counterclaim asserted.
She asserted Mowitz transferred the majority of their holdings into the trust prior to the divorce. She claimed he retained authority over the trust and kept her uninformed.
In another document, Green declared the trust had over $100 million invested. She claimed her ex’s income was an “enigma.”

In a separate filing, Mowitz accused his estranged wife of being the one who engaged in marital infidelity. He alleged she had one extramarital liaison.
Both parties disclaimed all accusations of wrongdoing in the legal matter.
As Us previously reported, Zolciak and Biermann, 40, separated in 2023 and are currently in the midst of finalizing their contentious divorce. They are both demanding sole guardianship of their minor children.
