Mario Lopez Wins Major Legal Battle Against $25 Million Defamation Lawsuit

Mario Lopez successfully defeated a $25 million legal claim initiated by a former cheerleader who alleged he ridiculed her online, an exclusive report by Us Weekly confirms.

A court session took place on Thursday, September 25, at the Los Angeles Superior Court concerning Desiree Townsend’s lawsuit targeting Lopez, age 51.

During the proceedings, the court ruled in favor of Lopez, rejecting all accusations leveled against him. Townsend had asserted that Lopez uploaded a 2009 video of her, taken from an old Inside Edition interview, to Instagram in 2024, alleging she was fabricating medical conditions.

The judiciary determined that the footage, despite its 2009 broadcast, remained a topic of public relevance even in 2024.

The presiding judge stated that Lopez’s comment “related to a matter of public concern.” The official court document further indicated, “[Lopez] therefore seems to have fulfilled his obligation to show that the purportedly damaging post served his right to petition or freedom of speech.”

The judge declared Lopez’s Instagram update to be a “non-actionable opinion,” meaning he cannot face legal action for it. “Considering that this allegedly defamatory post was shared on [Lopez’s] public, personal Instagram profile, and from the perspective of an typical follower of [Lopez’s] account, the Court concludes that the average person viewing this particular Instagram post would perceive it as nothing more than [Lopez’s] personal commentary on the 2010 Inside Edition broadcast,” the judge elaborated.

Furthermore, the court observed that given Lopez’s status as a celebrity television personality, rather than a qualified medical professional capable of diagnosing health conditions, his post appeared to be a “humorous take” on [Townsend’s] behavior depicted in the Inside Edition footage.”

The court approved Lopez’s petition for the dismissal of all allegations.

Previously in June, the ex-NFL cheerleader initiated legal proceedings against Lopez, citing defamation, invasion of privacy by false light, and deliberate infliction of emotional distress.

The legal complaint asserted its purpose was to make “Lopez answerable for misusing his public platform to slander and demean [Townsend] as retribution for her unwillingness to remain quiet.”

Townsend gained widespread attention in 2009 following an Inside Edition interview where she alleged that a flu vaccination led to unusual ailments such as impaired speech and difficulty ambulating. Television producers covertly trailed Townsend post-interview, recording segments where she seemed to walk unimpaired.

The production team confronted her unexpectedly in a parking area, but she maintained that she continued to experience health complications from the inoculation.

In her legal filing, Townsend alleged that Lopez shared a portion of the Inside Edition episode on his social media platforms. His caption read, “This performance definitely deserves an accolade… #MethodActor #OscarWorthy.”

Townsend responded to Lopez’s post, stating, “You are utterly repulsive. I have endured persistent harassment due to my rare condition … I wish for you to be terminated from your employment and never find work again. And I ASSURE YOU I will pursue a defamation lawsuit against you and your employers” at the entertainment news program, Access Hollywood.

The lawsuit contended that Lopez and his associates chose to hire a crisis public relations firm to discredit Townsend online. “The disparaging post aimed at [Townsend] rapidly garnered more than 1 million views, with a follow-up post escalating to 14.4 million views,” the complaint detailed.

“Despite suffering through more than 16 years of intense media examination, ridicule, and damage to her reputation, [Townsend] has consistently strived to reconstruct her life and re-establish her professional status,” the filing claimed. “[Lopez’s] libelous assertion, coupled with the fresh online vilification orchestrated by [Lopez], has subjected [Townsend] to renewed victimization and trauma by rekindling the identical untrue stories that have haunted her for over ten years.”

Lopez and his legal representatives from the prominent firm, Geragos & Geragos, responded to the lawsuit on August 12. The television personality refuted all accusations of improper conduct. His legal counsel contended, “[Townsend], possessing thorough awareness and comprehension of the situation and events, willingly engaged in, agreed to, sanctioned, and endorsed all actions taken by [Lopez] that [Townsend] now disputes.”

Furthermore, Lopez asserted that his remarks were safeguarded by the First Amendment. His lawyer further stated, “[Lopez] posits that [Townsend’s] accusations are invalid because [Lopez’s] statements constituted mere opinions, not factual assertions, and no sensible individual hearing them would have perceived them as anything other than subjective viewpoints.”

He requested that Townsend be awarded no damages from her legal action and that she be compelled to cover his litigation expenses.
