Todd Tucker Seeks Sole Custody of Children Amidst Divorce from Kandi Burruss
Exclusive reporting from Us Weekly reveals that Todd Tucker, the separated spouse of former The Real Housewives of Atlanta star Kandi Burruss, is seeking sole physical custody of their two children through legal divorce proceedings.
Tucker submitted his counter-petition to Burruss's divorce filing on Wednesday, November 26. In his submission, he stated that their two children are presently living with him in Georgia, under his direct care, as Burruss, aged 49, is engaged in “out-of-state work commitments.”
The former couple are parents to a son, Ace, who was born in 2016, and a daughter, Blaze, born in 2019.
Tucker, 52, emphasized that Burruss’ professional duties “will necessitate her absence from the children for a minimum of several more months,” supporting his request for primary physical custody.
The documents he submitted stated, “Both parties have been collaborating constructively to settle all matters, and [Tucker] pledges to maintain these good-faith negotiations.”
Tucker indicated that, “should they regrettably fail” to finalize a custody arrangement, he intends to pursue primary physical custody, shared legal custody, and ultimate decision-making power.”
He put forward the idea of “[Burruss] retaining significant time and valuable interaction with the children.” Tucker’s legal representative complimented Burruss on her parenting. His submission articulated, “[Tucker] wants to make it known that he acknowledges [Burruss] as an affectionate and competent mother and holds sincere optimism that ongoing and previous dialogues between them will lead to a complete settlement of all issues.”

Tucker acknowledged having executed a prenuptial agreement prior to their wedding on April 4, 2014, but implied he was coerced into signing it without the presence of his legal counsel.
Nevertheless, Tucker’s attorneys asserted that the pact “was put before [Tucker] when he was unrepresented by counsel, despite [Burruss’] legal team at the time having previously corresponded with [Tucker’s representatives] concerning a prospective prenuptial arrangement.”
“Despite this awareness, [Burruss’] legal counsel offered the finalized document to [Tucker] for endorsement right before the wedding event, without informing or consulting [Tucker’s team], who had been deeply involved in the negotiation phase,” Tucker’s submission claimed. “These conditions create considerable doubts regarding the validity of the aforementioned document. Nonetheless, [Tucker] is dedicated to resolving this issue through good-faith discussions, amicably and confidentially where feasible.”
Tucker’s cross-petition for divorce additionally sought an “equitable distribution of all communal assets, encompassing both real and personal property, and both tangible and intangible holdings, between the estranged couple.”

Tucker requested primary physical custody, shared legal custody, and the possibility of spousal support if the prenuptial agreement is determined to be invalid.
