ASOS Faces German Duty Dispute Over Millions in Alleged Underpayments
British fast-fashion retailer ASOS has confirmed it is engaged in discussions with the German customs authority regarding a legal dispute over alleged underpayments of import duties. The company’s announcement on Friday followed an earlier report by The Financial Times, which detailed that German tax authorities are pursuing ASOS for unpaid customs duties stemming from declarations made on its shipments that have crossed the German border over several years.
The core of the dispute revolves around customs declarations on a vast number of consignments, with German authorities contending that ASOS has not paid the correct amount of import duty. ASOS, however, stated that it is actively contesting the assessments made by the German customs authority, maintaining that its maximum potential exposure to this issue is "immaterial" in the grand scheme of its operations.
To address the allegations, ASOS has undertaken a comprehensive review of the customs declarations in question. The company reported that it has scrutinized more than 95% of the tens of thousands of customs declarations currently under the microscope. Based on its thorough analysis, ASOS estimates the additional liability associated with this dispute to be approximately 0.5 million euros, equivalent to about $585,900.
This development comes at a challenging time for the online fashion giant. Just last month, ASOS had issued a warning that its annual revenue would likely fall short of market expectations. This projected shortfall was attributed to weak consumer demand across its key markets, with the company also anticipating its profit figures to land at the lower end of its previously forecast range.
In response to the demanding market conditions, ASOS has been actively implementing strategies to revitalize its fast-fashion appeal. This involves refocusing on its core demographic of shoppers in their 20s, while simultaneously executing significant cost-cutting measures. The retailer is also navigating an increasingly competitive landscape, intensified by the rise of Chinese rivals, alongside the ongoing impacts of global trade dynamics.
