Shein Stays in France Despite Court Rejection of Suspension Request

Shein, the ultra-fast fashion giant, will continue operating in France throughout the holiday season after a French court rejected the government’s request for a three-month suspension. The decision, delivered on December 19th, follows concerns raised about the sale of illicit products on the Singapore-based marketplace.

The court’s inclination towards this outcome was anticipated, as the public prosecutor indicated during a December 5th hearing that a complete ban would be disproportionate under EU law. Nevertheless, the ruling represents a setback for the French government, which had previously expressed expectations of significant sanctions against Shein.

The government’s request, made under article 6-3 of the law safeguarding trust in the digital economy, sought either a complete block or a temporary suspension of Shein’s platform. This action was prompted by the discovery of objectionable items available for purchase, including sex dolls resembling young children, prohibited weaponry categorized as “category A arms,” and banned pharmaceutical products.

During the December 5th hearing, Shein’s legal team denounced the government’s actions as a politically motivated “conspiracy.” While acknowledging the presence of the problematic products, Shein maintained that they were promptly removed upon notification and that the company subsequently implemented appropriate corrective measures. They also highlighted a voluntary suspension of their French site as evidence of their responsiveness.

Currently, Shein’s French operations are limited to the sale of its signature ultra-low-cost clothing collections, primarily manufactured in China using synthetic materials. The company states it is undertaking a “complete audit” to address any identified “flaws” within its systems.

Despite the court’s decision, the legal and regulatory challenges facing Shein are not yet resolved. As long as the website remains accessible to French consumers, the dispute will continue. France has also escalated the matter to the EU level, requesting sanctions against the company.
